Requirement to Maintain CRP Approved

As a requirement of all CRP contracts the participant SHALL maintain the approved cover according to the conservation plan, including minimum practice seeding standards, in accordance with CRP-1 Appendix Part 4 & 5, 2-CRP (Rev. 5) Subparagraph 427A, 7-CFR 1410.20 and 7-CFR 1410.22. When a violation for failure to maintain the approved cover is found at any time during the contract period, FSA will proceed according to 2-CRP (Rev. 5) paragraphs 571, 603 and 604.

The practices and management activities included in the CRP conservation plan and agreed to by the participant must cost-effectively reduce erosion necessary to maintain the productive capability of the soil, improve water quality, protect wildlife or wetlands, protect a public well head, improve grassland, or achieve other environmental benefits as applicable. The producer must undertake management activities on the land as needed throughout the term of the CRP contact to implement the conservation plan.

Common Examples of Noncompliance

an unauthorized crop, such as an agricultural commodity, has been planted on acreage under CRP-1

producer conducted an activity on CRP acres without authorization, including unauthorized treatment, such as mowing, spraying, and/or burning of CRP during the primary nesting season

the producer has not performed required MCM activities according to the conservation plan

the approved cover has not been maintained according to the conservation plan o approved cover has been destroyed

approved cover was not seeded

approved cover has not been maintained according to the practice requirements

approved cover is inundated by voluntary trees on CRP
