Palo Alto County Supervisors Learn About Setback on Drainage District 180,

Gets First Look at Solar Energy Ordinance

The Palo Alto County Board of Supervisors discussed a Ruling handed down by the Honorable Judge Don E. Courtney, District Court Judge, Third Judicial District of Iowa, on Friday, August 23, 2019, during their regular meeting on Tuesday, August 27.

The Ruling stems from a lawsuit brought by the Wild Rose Casino against the Palo Alto County Board of Supervisors in regards to improvements to Drainage District 180 Lateral 1.

The Supervisors acting as trustees of the drainage district 180 held a meeting September 19, 2018 where several objections were thrown out because the landowners were not part of the drainage district at that time. Since remonstrance was not met, the Board approved the recommendation to go ahead with the improvements and began digging the open ditch.
